Judge dismisses complaint over injuries sustained at Mardi Gras

A plaintiff who allegedly suffered an injury while at Mardi Gras has dropped his complaint. mardi-gras-mask

Frederick Jones elected to refrain from pursuing his claims against Mardi Gras of Southeast Texas Inc. and AAA Rentals, according to court records filed Sept. 4 in Jefferson County District Court.

In his original complaint filed Aug. 29, 2011, Jones claimed he was injured when a Mardi Gras tent fell on him on March 5, 2011, during the festival. AAA Rentals had leased the tent to Mardi Gras of Southeast Texas, according to the complaint.

In his complaint, Jones alleged the defendants were responsible for the condition of the tent and should have made sure it was safe.

The judgment further states AAA Rentals dropped its cross-claim against Mardi Gras Southeast Texas.

On April 5, AAA Rentals had filed an amended answer and cross-claim against Mardi Gras Southeast Texas, court records show.

The cross-claim alleged Mardi Gras Southeast Texas breached its contract with AAA Rentals by failing to secure it as an additional insured on its insurance policy.

Jones was suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages, plus all court costs.

Beaumont attorney Trenton Bond of Portner Bond represents him.

Attorney Mitchell Toups of the Weller, Green, Toups & Terrell law firm in Beaumont represents AAA rentals.

Judge Bob Wortham, 58th District Court, is assigned to the case.
